Fortunately, <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/archives\/measure_indiv_Archives.aspx?billtype=HB&amp;billnumber=1434&amp;year=2022\">House Bill 1434<\/a> did not pass <a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/Session2022\/Testimony\/HB1434_TESTIMONY_CPC_02-15-22_.PDF\">last year<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"605\" src=\"https:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.21.54-PM-1024x605.png\" alt=\"\" class=\"wp-image-2654\" srcset=\"http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.21.54-PM-1024x605.png 1024w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.21.54-PM-470x278.png 470w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.21.54-PM-768x454.png 768w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.21.54-PM-1536x907.png 1536w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.21.54-PM-2048x1210.png 2048w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.21.54-PM-624x369.png 624w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>This year\u2019s package includes another request for <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=106&amp;year=2023\">\u201cnonjudicial foreclosure,\u201d<\/a> aka \u201cpower of sale.\u201d  <strong>2023<\/strong> <strong>HB 106<\/strong> BELOW represents an alarming threat to property owners and is prevalent in totalitarian regimes.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"672\" src=\"https:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.22.23-PM-1024x672.png\" alt=\"\" class=\"wp-image-2655\" srcset=\"http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.22.23-PM-1024x672.png 1024w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.22.23-PM-470x308.png 470w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.22.23-PM-768x504.png 768w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.22.23-PM-1536x1008.png 1536w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.22.23-PM-2048x1344.png 2048w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-3.22.23-PM-624x409.png 624w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>This year\u2019s <strong><a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=106&amp;year=2023\">HB 106<\/a><\/strong> offers weak assurance that <em>\u201ca county may, after all notices, orders, and appeal proceedings are exhausted, satisfy all unpaid civil fines through the power of sale on the real property subject to a recorded lien.\u201d <\/em><\/p>\n\n\n\n<p>Unfortunately, our years of civic participation at Honolulu Hale show that due process has not always been fair and equitable to <a href=\"https:\/\/countrytalkstory.com\/?p=1842\">ordinary residents<\/a>.<\/p>\n\n\n\n<p>Furthermore, <a href=\"https:\/\/www.justice.gov\/usao-hi\/pr\/six-charged-bribery-schemes-official-acts-department-planning-and-permitting-city-and-0\">recent<\/a> federal <a href=\"https:\/\/www.khon2.com\/local-news\/five-honolulu-department-of-planning-workers-accused-of-bribery-in-federal-indictments\/\">indictments <\/a>and guilty pleas continue to show the <a href=\"https:\/\/ownerbuiltdesign.com\/the-challenges-of-working-with-the-honolulu-department-of-planning-and-permitting\/\">troubled<\/a> <strong>Honolulu Department of Planning and Permitting (<a href=\"https:\/\/www.hawaiibusiness.com\/hawaii-building-permit-delays-top-nation-uhero-study-real-estate-carl-bonham\/\">DPP<\/a>)<\/strong> has no consistent <a href=\"https:\/\/www.slideshare.net\/civilbeat\/haseko-homeowners-request-for-investigation-of-dpp\">record<\/a> of <a href=\"https:\/\/www.civilbeat.org\/2023\/01\/honolulu-permitting-inspector-okd-his-own-companys-projects\/\">fair play<\/a> or <a href=\"https:\/\/www.khon2.com\/local-news\/more-permit-delays-cause-frustration-at-city-planning-department\/\">efficient<\/a> management. Written testimonies reveal alarming threats toward private property rights.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/session2023\/Testimony\/HB106_TESTIMONY_JHA_01-31-23_.PDF\"><strong>Dawn Takeuchi Apana<\/strong><\/a>, DPP director designate, stated: \u201cSpecifically, this bill would authorize the city to bring closure to pending civil fines imposed on landowners who are in violation of the city\u2019s land use ordinances and building codes, through a nonjudicial or administrative process.\u201d<\/p>\n\n\n\n<p>Honolulu City Councilman <strong><a href=\"https:\/\/www.hawaiinewsnow.com\/2021\/01\/27\/former-no-under-caldwell-is-working-council-get-taxpayer-funded-benefits\/\">Calvin Say<\/a> <\/strong>also submitted testimony for a quicker seizure: \u201cOur city corporation counsel is currently able to initiate a Judicial Foreclosure process, which has been successful in similar instances, however this is a long process that takes valuable resources away from other pressing legal matters.\u201d<\/p>\n\n\n\n<p>In other words, give us the authorization to hurry it up by bypassing the regular court method of foreclosure.<\/p>\n\n\n\n<p>The <strong>House Committee on Judiciary &amp; Hawaiian Affairs<\/strong>, whose members include <a href=\"https:\/\/www.civilbeat.org\/2023\/02\/why-does-just-one-person-get-to-decide-important-issues-like-term-limits\/\">Chairman David Tarnas<\/a> and Vice Chair Gregg Takayama, <a href=\"https:\/\/www.youtube.com\/watch?v=kw9jCAskYCs\">approved<\/a> HB 106 on Jan. 31. Its report states in part:<\/p>\n\n\n\n<p><em>\u201cYour committee finds that authorizing the counties to collect on liens filed on properties through a nonjudicial foreclosure process provides some leverage over property owners to comply or lose their property. Each county\u2019s goal should be to help property owners comply with the law and correct their violations,&nbsp;<em>not<\/em>&nbsp;summarily seize their properties.<\/p>\n\n\n\n<p>HB 106 invites corruption and exposes residents, especially those who have fewer financial resources available to them, as easy casualties of this potential power of sale. <strong>All Hawaii counties<\/strong> would be affected.<\/p>\n\n\n\n<p>It should be noted the <strong>U.S. Supreme Court <\/strong>ruled unanimously on Feb. 20, 2019 (<a href=\"https:\/\/www.aclu.org\/cases\/timbs-v-indiana\">Timbs vs Indiana<\/a>), that the Constitution\u2019s ban on excessive fines \u2014 civil asset forfeitures are a type of fine \u2014 applies to state and local governments, thus limiting their ability to use fines to raise revenue.<\/p>\n\n\n\n<p>The late Justice <strong>Ruth Bader Ginsburg<\/strong> also astutely argued fines could be used to retaliate against political enemies and had been used as a source to raise revenue.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"611\" src=\"https:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-9.00.08-AM-1024x611.png\" alt=\"\" class=\"wp-image-2651\" srcset=\"http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-9.00.08-AM-1024x611.png 1024w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-9.00.08-AM-470x280.png 470w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-9.00.08-AM-768x458.png 768w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-9.00.08-AM-1536x917.png 1536w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-9.00.08-AM-2048x1222.png 2048w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/02\/Screen-Shot-2023-02-15-at-9.00.08-AM-624x372.png 624w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption><a href=\"https:\/\/www.alreporter.com\/2020\/09\/19\/u-s-supreme-court-justice-ruth-bader-ginsburg-dies-at-87\/\">RBG<\/a> was a tireless and resolute champion of justice.<\/figcaption><\/figure>\n\n\n\n<p>Hawaii has a few egregious property owners, but this tyrannical bill is not the solution.
