{"id":2697,"date":"2023-03-06T16:19:30","date_gmt":"2023-03-07T02:19:30","guid":{"rendered":"https:\/\/countrytalkstory.com\/?p=2697"},"modified":"2023-03-12T00:56:31","modified_gmt":"2023-03-12T10:56:31","slug":"whos-who-with-these-power-of-sale-bills","status":"publish","type":"post","link":"http:\/\/countrytalkstory.com\/?p=2697","title":{"rendered":"Who&#8217;s behind these non-judicial Power of Sale bills?"},"content":{"rendered":"\n<p>UPDATE: <a href=\"http:\/\/capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SB&amp;billnumber=875&amp;year=2023\">SB 875<\/a> &amp; <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=15&amp;year=2023\">HB 15<\/a> are speeding on. ( <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=538&amp;year=2023\">HB 538<\/a>  is quite similar.)<\/p>\n\n\n\n<p>Keep in mind the counties already have &#8220;Judicial Foreclosure&#8221; and &#8220;Eminent Domain&#8221; powers in place.  But the justification is that these processes take too long.<\/p>\n\n\n\n<p>In other words, these bills will allow the counties to be the Police, Prosecutor, Jury, Judge, and Executioner. The Judicial Due Process will be cut off.<\/p>\n\n\n\n<p>We&#8217;re asked who started these non-judicial foreclosure bills to <strong>forced sale<\/strong> of a private property, based on the Honolulu Department of Planning and Permitting (DPP) fines, <strong>without going to court<\/strong>. <\/p>\n\n\n\n<p>Here are some quick answers:<\/p>\n\n\n\n<p>It originated in 2022 as <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/archives\/measure_indiv_Archives.aspx?billtype=HB&amp;billnumber=1434&amp;year=2022\">HB 1434<\/a> with Honolulu Mayor Rick Blangiardi. Keep it mind that this <a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/Session2022\/Testimony\/HB1434_HD1_TESTIMONY_GVO_03-15-22_.PDF\">Power of Sale<\/a> requests applied to <a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/Session2022\/Testimony\/HB1434_HD1_TESTIMONY_GVO_03-15-22_.PDF\">ALL Counties<\/a> in Hawaii.  Based on my observations of him, it&#8217;s unlikely that this non-judicial Power of Sale idea originated from Blangiardi unless he&#8217;s hoping for a new stream of revenues from fines and sale of properties.<\/p>\n\n\n\n<p>If I have to take a guess, it would be his Managing Director <a href=\"https:\/\/mauinow.com\/2019\/05\/30\/mike-formby-new-executive-director-of-pacific-resource-partnership\/\">Mike Formby<\/a>, formerly with the Pacific Resource Partnership (PRP) or former Department of Planning and Permitting (<a href=\"https:\/\/www.ssfm.com\/project\/dean-uchida\/\">DPP<\/a>) Director <a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/Session2022\/Testimony\/HB1434_TESTIMONY_CPC_02-15-22_.PDF\">Dean Uchida<\/a>. <\/p>\n\n\n\n<p>Five (5) City Council members, known as the Gang of 5, also submitted testimony &#8211; Chair <a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/session2023\/Testimony\/HB498_TESTIMONY_CPC_02-02-23_.PDF\">Tommy Waters<\/a>, Esther Kia&#8217;iana, Brandon Elefante, <a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/Session2022\/Testimony\/HB1434_HD1_TESTIMONY_JHA_02-23-22_.PDF\">Calvin Say<\/a>, and <a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/Session2022\/Testimony\/HB1434_HD1_TESTIMONY_GVO_03-15-22_.PDF\">Radiant Cordera<\/a>.<\/p>\n\n\n\n<p>What were the underlying motives?<\/p>\n\n\n\n<p>Fortunately, Bill 1434 failed to pass last year. <\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/03\/Screen-Shot-2023-03-06-at-2.34.36-PM.png\" alt=\"\" class=\"wp-image-2698\" width=\"599\" height=\"536\" srcset=\"http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/03\/Screen-Shot-2023-03-06-at-2.34.36-PM.png 599w, http:\/\/countrytalkstory.com\/wp-content\/uploads\/2023\/03\/Screen-Shot-2023-03-06-at-2.34.36-PM-470x421.png 470w\" sizes=\"auto, (max-width: 599px) 100vw, 599px\" \/><figcaption>I was in the same Mayoral campaign with Rick Blangiardi in 2020. Based on my observations and <br \/>his words, he had very shallow understanding about Honolulu City Hall workings.<\/figcaption><\/figure>\n\n\n\n<p>This year 2023, Mayor Blangiardi is back with <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=106&amp;year=2023\">HB 106<\/a> and <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SB&amp;billnumber=216&amp;year=2023\">SB 216<\/a> by request to Senate President Ron Kouchi and House Speaker Scott Saiki.  <\/p>\n\n\n\n<p>However, presto! The tactics have changed a bit this year. There are five (5) clone bills with the same agenda speeding through.<\/p>\n\n\n\n<p>Google Searches show no county mayors, state legislators or city council members appear to have warned Hawaii about this draconian assault on private properties.<\/p>\n\n\n\n<p><strong>Here are the rest of the three (3) bills.<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SB&amp;billnumber=875&amp;year=2023\"><strong>SB875<\/strong><\/a> is introduced by <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/legislators.aspx?chamber=S\">Senators<\/a> Stanley <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=157&amp;year=2023\">Chang<\/a>, Donovan <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=162&amp;year=2023\">Dela Cruz<\/a> and Sharon <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=198&amp;year=2023\">Moriwaki<\/a>. It is introduced by <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=89&amp;year=2023\">MATAYOSHI<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=7&amp;year=2023\">BELATTI<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=56&amp;year=2023\">HASHIMOTO<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=59&amp;year=2023\">HOLT<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=266&amp;year=2023\">KILA<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=76&amp;year=2023\">KITAGAWA<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=270&amp;year=2023\">LAMOSAO,<\/a> <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=87&amp;year=2023\">MARTEN<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=103&amp;year=2023\">NISHIMOTO<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=290&amp;year=2023\">TAKENOUCHI<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=135&amp;year=2023\">TARNAS<\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/legislature\/memberpage.aspx?member=252&amp;year=2023\">Chun<\/a>. <\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.kitv.com\/news\/building-permit-delays-cost-oahu-homeowners-big-money\/article_6451d7b0-b7b7-11ec-8226-430a162ea69a.html\">time line<\/a> provided in this bill is too unrealistic. It assumes that DPP is 100% <a href=\"https:\/\/www.hawaiinewsnow.com\/2021\/04\/01\/kahala-homeowner-says-former-dpp-employee-arrested-by-fbi-delayed-his-permits-back\/\">efficient.<\/a> In actual fact, it takes a very long time to get a permit. Some permits take a much longer time because it may need a shoreline certified shoreline.
